MUMBAI: The Bombay high court quashed a look out circular (LOC) of Oct 2019 against a Mumbai resident, an alleged associate of gangster Iqbal Mirchi.
The Enforcement Directorate has filed a complaint under the Prevention of Money Laundering Act (PMLA) against R D Bindra, 45, which is pending before a Special trial court in Mumbai.
The HC division bench of Justices Revati Mohite Dere and S C Chandak observed that the Ministry of Home Affairs via a Feb 2021 memorandum requires the agency to keep reviewing the LOCs opened at its behest on a quarterly and annual basis and submit the proposals to delete the LOC, if any, immediately after such a review.The ED disclosed no material before the HC if it conducted such a review to keep the LOC pending, despite being asked to do so.
The HC said the LOC said Bindra is suspected to be involved in the conspiracy to transfer the proceeds of crime overseas.
The HC after hearing Bindra’s counsel Tapan Thatte with advocate Ravi Kotian as well as ED counsel Shriram Shirsat said since review was not conducted allowed Bindra’s quashing petition and set aside the LOC issued ar ED’s behest against him.
